SENATE CONCURRENT RESOLUTION NO. 3

Bowman, Plymale, Snyder, Love, Mitchell, Caldwell, Rowe, Hunter,
Burnette, Facemyer, Sprouse, Bailey, Wooton, Jackson, Chafin,
Tomblin, Mr. President, and Craigo)
Authorizing the issuance of negotiable bonds and notes to provide
funds for the construction, reconstruction, renovation and
maintenance of one or more skilled nursing facilities to serve
the needs of West Virginia veterans.

Whereas, The health and welfare of West Virginia veterans
would be best served by the establishment of one or more skilled
nursing facilities exclusively for veterans; and

Whereas, With nearly 200,000 veterans, West Virginia has the
highest level of participation per capita of any state in wars and
conflicts fought by this nation; and

Whereas, The aging veteran population, which suffers from
wartime disabilities and illnesses, is, or will be, in need of
skilled nursing care; and

Whereas, During the First Extraordinary Session, 2001, the
Legislature enacted Enrolled Senate Bill No. 1005, which provides
for the sale of revenue bonds by the Hospital Finance Authority to
fund one or more skilled nursing facilities to be constructed,
equipped, staffed and operated by the Director of the Division of Veterans' Affairs to house and serve veterans of the United States
armed forces who are citizens of the state; and

Whereas, In accordance with the provisions of Enrolled Senate
Bill No. 1005, the adoption of a concurrent resolution by the
Legislature will authorize the Hospital Finance Authority to permit
the issuance of negotiable bonds and notes in a principal amount
which is necessary to provide sufficient funds for the
construction, reconstruction, renovation and maintenance of one or
more skilled nursing facilities that will exclusively serve the
needs of West Virginia veterans who have performed active duty in
either an active or reserve component of the armed forces. The
bonds issued by the Authority may not exceed $10 million. The
revenues pledged for the repayment of principal and interest of
these bonds shall include the net profit of the veterans instant
lottery scratch-off game authorized by section nine-a, article
twenty-two, chapter twenty-nine of the code of West Virginia; and

Whereas, Except as may otherwise be expressly provided by the
Hospital Finance Authority, every issue of its bonds or notes shall
be special obligations of the Authority, payable solely from the
property, revenues or other sources of or available to the
Authority which were pledged therefor; and

Whereas, The bonds and notes shall be authorized by resolution
of the Authority, shall bear the date and shall mature at time or
times, in the case of any such note or any renewals thereof, not exceeding seven years from the date of issue of the original note
and in the case of any bond not exceeding fifty years from the date
of issue, as the resolution may provide; therefore, be it
Resolved by the Legislature of West Virginia:

That the Legislature, in accordance with the provisions of
Enrolled Senate Bill No. 1005, enacted during the First
Extraordinary Session, 2001, hereby authorizes the issuance of
negotiable bonds and notes to provide funds for the construction,
reconstruction, renovation and maintenance of one or more skilled
nursing facilities to serve the needs of West Virginia veterans;
and, be it

Further Resolved, That the revenues pledged for the repayment
of principal and interest of these bonds shall include the net
profit of the veterans instant lottery scratch-off game authorized
by section nine-a, article twenty-two, chapter twenty-nine of the
code of West Virginia; and, be it

Further Resolved, That, except as may otherwise be provided by
the Hospital Finance Authority, every issue of its bonds or notes
shall be special obligations of the Authority, payable solely from
the property, revenues or other sources of or available to the
Authority which were pledged therefor; and, be it

Further Resolved, That the Clerk of the Senate is hereby
directed to forward a copy of this resolution to the Governor and
the Hospital Finance Authority.
